Good day neighbors,

I think most of us have or will soon receive the latest dues demand from Mr. Rutherford. Before you get out your
checkbook I’d suggest you peruse the information I’ve attached to this email:

The document is a court order and judgment against these defendants; The Subdivision of Rivermont Ranch, David M.
Rutherford and a John Doe unknown trustee. Some of you might recall that Mr. Rutherford who appointed himself to be
the Road Fund Manager and the Land Owners Chairperson threatened to take these actions in 2011. It appears that he
filed a lien against Gunflahr Land for $11,600 and included the entire subdivision in his lien filing without
notifying those who live in our subdivision of his actions. Gunflahr contested the lien. A hearing was held on
6/5/2015 at which neither Mr. Rutherford nor any of the other defendants showed up. I’d think that if any of us
knew about this matter we would have been there but since we didn’t and Mr. Rutherford didn’t appear, the judge
found that “Rivermont and Rutherford knew that the calculation of assessments in the statement submitted to US
Title was arbitrary, incorrect and/or not supported by any authority of the Declarations and/or Road Agreement or
other recorded documents” declared the liens to be “null and void” and determined that “all remaining unreimbersed
costs are to be taxed against defendants Rivermont and Rutherford”

I’ve also attached a copy of Mr. Rutherford’s lien threat letters, a copy of a letter he sent in April 2005 after
we met and I gave him a copy of the expired Covenants and restrictions and other related documents. Note on the
last paragraph of page 1, he clearly establishes his knowledge and understanding that the “subdivision road
assessments are voluntary” and I’ve attached a copy of the last legitimate Covenants and Restrictions governing
Rivermont Ranch that expired on January 1, 1988.

I’d strongly suggest that you also access the Missouri Case Net website and search by the name David M. Rutherford
prior to sending any money to whoever is sending these so called bills. The first thing you will notice is that he
is giving an address as a suite in Destin Florida. You will also notice that there are 5 pages of litigation's that
involve Mr. Rutherford. If you check the records thoroughly you will find many well-known banks and credit unions
and businesses are plaintiffs. If you look to the judgments and garnishments against him you will find that they
add up to tens of thousands of dollars. You will also find that David and Lynda Rutherford still have a case or two
to attend in the future.

I don't know how many other liens Mr. Rutherford might have filed, if any but we do know he threatened to file
more than just Gunflahr so you might also want to share this information with your neighbors and possibly contact
the sheriff's department and the prosecuting attorney's office.
